HOW LONG DOES IT TAKE TO GET DIVORCED?  The time it takes to get divorced varies. In general a divorce with no children will take a minimum of 60 days. A divorce with children will take 6 months. The 6 month waiting period can be reduced in certain circumstances.



IF I AM SERVED WITH A COMPLAINT FOR DIVORCE SHOULD I RESPOND?  Yes you should. It is important that you file an answer to the Plaintiff’s complaint so that your voice can be heard. If you fail to file a written answer to the Plaintiff’s complaint you could be defaulted and then your voice will not be heard.



WHAT IS A DEFAULT?  A party can file a default if a party served with a complaint for divorce fails to answer in the time prescribed by law. Once defaulted you cannot participate in the proceeding and you will have to file a motion to set aside the default.



HOW MUCH DOES DIVORCE COST?  The cost for filing a complaint for divorce with children is $230.00. The cost for filing a complaint for divorce without children is $150. The court will waive these fees if you if you meet certain financial qualifications.



HOW LONG DO I HAVE TO FILE AN ANSWER TO THE PLAINTIFF’S COMPLAINT FOR DIVORCE?  If you are personally served (a 3rd party hands you the document) you have 21 days to answer in writing. If you are served by mail you have 28 days to file an answer to the Plaintiff’s complaint.



WHAT HAPPENS IF THE PARTIES CANNOT AGREE ON THE TERMS OF THE DIVORCE JUDGMENT?  If the parties cannot agree the court will likely refer them to mediation. If the parties cannot agree after mediation the matter is generally set for trial.
